It’s not uncommon to look for a fresh start when the calendar turns to a new year. And for that reason, January is one of the most common months for divorce filings.

If you’re considering divorce and have plans to go down this path in the new year, there are a variety of steps you can take right now to prepare:

Talk to your spouse about your feelings: Maybe you want to do this now, or wait until after the holiday season. Should you decide to talk about it now, you’re in better position to begin the process when the new year arrives.
Think about your future: How will you support yourself? How will you maintain your relationship with your children? Where will you live? These are questions that will need to be answered.
Learn more about the divorce process: Focus on details such as property and debt division, child custody, child support and spousal support. All of these things have the potential to move to the forefront in your divorce. The more you learn now, the less stress you’ll have as the process begins.
If a fresh start is what you want and your marriage is on the rocks, a divorce in the new year could be the right solution.

Before you head down this path, consider the pros and cons of doing so. This isn’t a decision you make on a whim. Once you’re 100% on board with divorce, take the appropriate steps to prepare for the process and protect your legal rights.
